• City Ordinances and Code Enforcement: Municipalities such as Portland, Beaverton, and Gresham enforce property maintenance and safety codes to address hoarding conditions that create hazards or extend onto surrounding property. Code enforcement officials may issue citations, impose fines, and, in severe cases, seek court-ordered cleanups or eviction proceedings.
• Health and Safety Hazards: Authorities may declare a residence “unsafe to occupy” when excessive clutter creates blocked exits, fire dangers, structural concerns, sanitation problems, or pest infestations. In these situations, local agencies may intervene to protect public safety.
• Reasonable Accommodation Under Fair Housing Laws: Under the Fair Housing Act (FHA) and Americans with Disabilities Act (ADA), individuals with hoarding disorder may be entitled to reasonable accommodations. Housing providers are generally expected to allow tenants an opportunity to address safety or sanitation violations before pursuing eviction.
