Louisiana Legal Requirements: Helpful Tips
  • Property Maintenance and Public Nuisance Laws: Under Louisiana law, including RS 14:107.3, property that is poorly maintained to the extent that it creates unsafe, unhealthy, or blighted conditions may be classified as a public nuisance or blighting influence. RS 33:1373 also addresses buildings deemed dilapidated, unsanitary, unsafe, or otherwise hazardous to the public.
  • Penalties for Criminal Blight: Violations involving criminal blight or nuisance conditions may result in fines of up to $500 for a first offense, along with court orders requiring correction of the hazardous or unsanitary conditions.
  • Animal Hoarding Cases: Louisiana generally prosecutes animal hoarding situations under existing animal cruelty and neglect statutes rather than under a separate hoarding-specific law. These cases often involve allegations of inadequate care, unsanitary conditions, or neglect of animals.
  • Animal Cruelty and Animal Seizure: Louisiana’s animal cruelty statute, RS 14:102.1, may be applied in hoarding-related cases. Enforcement actions can include seizure and forfeiture of animals, criminal penalties, and possible restrictions on future animal ownership.
  • Local Ordinances and Code Enforcement: Many Louisiana parishes and municipalities maintain additional public health, fire safety, and property maintenance regulations that may be used to require cleanup of excessive debris, hazardous clutter, or unsafe living conditions.
