Alabama Legal Requirements: Helpful Tips
- Adult Protective Services (APS):
- The Alabama Department of Human Resources investigates hoarding cases involving elderly or disabled adults who are unable to protect themselves. Under the 1976 Adult Protective Services Act, the agency may provide services, conduct investigations, and seek emergency court intervention when necessary.
- Public Nuisance Laws:
- Hoarding conditions that create unsafe, hazardous, or unsanitary environments may be classified as a public nuisance under Alabama law.
- Local Ordinances:
- In Alabama municipal governments may condemn or take action against properties considered dangerous or uninhabitable due to conditions such as waste accumulation, fire hazards, or lack of utilities.
- Fair Housing and ADA Protections:
- Because hoarding disorder is often recognized as a mental health condition, individuals may have certain protections under the Fair Housing Act and the Americans with Disabilities Act, including the possibility of reasonable accommodations in some circumstances.
- Animal Hoarding:
- Animal hoarding cases in Alabama may be prosecuted under state animal cruelty laws. Each neglected animal can be charged as a separate offense, and severe situations may rise to a felony under Ala. Code § 13A-11-14.1.
